Terms of Service
These Terms of Service (“Terms”) govern your use of PodPilot, including the website at https://podpilot.fun and the PodPilot service (together, the “Service”), provided by PodPilot (“PodPilot”, “we”, “us” or “our”). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Description of PodPilot
PodPilot connects authorized Google accounts with AI-powered tools and agents. After you authorize access through Google, PodPilot allows the AI tools and agents you use to interact with the connected Google services on your behalf, within the permissions you approved.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and “you” refers to both you and the organization.
3. Connected Google accounts
To use the Service you must connect one or more Google accounts. You represent that you own or are authorized to use each account you connect, and that connecting it does not violate any agreement or policy that applies to you, including any policy of a Google Workspace organization that administers the account.
4. Authorization
PodPilot requests access to Google services only through Google’s OAuth authorization process. Google shows you the specific permissions being requested, and PodPilot receives only the access you explicitly approve. You may decline any request, and you may revoke access at any time from your Google Account permissions page. Revoking access will stop the Service from working with the affected account.
5. AI agents acting on your behalf
The Service allows AI tools and agents that you choose and control to perform actions in your connected Google services, such as reading, drafting, sending or organizing content, to the extent you have authorized. Actions taken through the Service by an AI tool or agent you have authorized are treated as actions taken by you. You are responsible for configuring, supervising and reviewing the tools and agents you authorize.
6. User responsibility
You are responsible for:
- Maintaining the security of your Google accounts and of any tools, agents or devices that can use the Service;
- All activity that occurs through your connected accounts using the Service, including actions initiated by tools or agents you authorize;
- Reviewing the permissions you grant and granting only the access you are comfortable with;
- Ensuring that your use of the Service, and any content you process through it, complies with applicable law and with the terms and policies of Google and any other third party involved.
7. Acceptable use
You agree not to use the Service to:
- Violate any applicable law or regulation, or the rights of others;
- Access accounts or data that you are not authorized to access, or circumvent any authorization or security mechanism;
- Send spam, unsolicited bulk messages, phishing or other deceptive or harmful communications;
- Distribute malware or interfere with the operation of the Service or any third-party service;
- Violate Google’s terms of service, API terms or acceptable use policies;
- Reverse engineer, scrape, overload or otherwise misuse the Service except as permitted by law.
We may suspend or terminate access for use that violates this section.
8. Third-party services
The Service works with third-party services, including Google services and the AI tools, agents and model providers you choose to use. We do not control those services and are not responsible for their availability, accuracy, content, policies or practices. Your use of any third-party service is governed by that third party’s own terms and policies.
9. Google services
Your use of Google services through PodPilot is subject to Google’s applicable terms, including the Google Terms of Service and Google’s privacy policy. Google may change or discontinue its APIs, change the permissions it offers, or restrict access at any time, which may affect or interrupt the Service. PodPilot’s use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements, as described in our Privacy Policy.
10. AI-generated output and actions
Content generated and actions taken by AI tools and agents may be inaccurate, incomplete, inappropriate or not what you intended. AI systems can misinterpret instructions and can take actions with real consequences, such as sending an email or modifying data. You should review AI-generated output before relying on it and configure your tools and agents with appropriate limits. We are not responsible for the content generated by, or the actions taken by, AI tools or agents you authorize.
11. Availability
We aim to keep the Service available but do not guarantee that it will be uninterrupted, timely, secure or error-free. We may modify, suspend or discontinue all or part of the Service at any time, with or without notice.
12. Intellectual property
The Service, including its software, design, name and content, is owned by PodPilot or its licensors and is protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You retain all rights to your own content and data, including data in your Google accounts.
13. Termination
You may stop using the Service at any time and may revoke PodPilot’s access to your Google accounts through Google. We may suspend or terminate your access to the Service at any time, including if we believe you have violated these Terms or if we discontinue the Service. Sections that by their nature should survive termination, including Sections 10, 12, 14 and 15, will survive.
14. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE ACCURATE OR RELIABLE, OR OPERATE WITHOUT INTERRUPTION OR ERROR. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PODPILOT AND ITS OPERATORS, AFFILIATES AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING ANY ACTIONS TAKEN BY AI TOOLS OR AGENTS YOU AUTHORIZE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED US DOLLARS (US$100).
16. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page and, for material changes, provide additional notice where reasonably possible. Your continued use of the Service after a change takes effect means you accept the updated Terms.
